John Adams When john Adams left the presidency he wanted to make it as difficult as possible for Thomas to change things. He therefore appointed 42 new justices who were loyal to his ideals and against Jefferson's. Because they were appointed so late they were termed, midnight judges

Thomas JeffersonWhen Jefferson took office he was extremely upset with Adams at trying to stop his ideas of change for the country's good. He therefore didn't send the commissions to some of the new judges and ignored the fact that they were offered the job.

William MarburyWilliam was one of the appointed midnight judges who did not receive the commission. He was so upset by this he sued the new president and requested that the supreme court make the president give him the papers and allow him to act in his new job as a judge.

John MarshallNoted as bein a very fair judge, he decided that although it was probably wrong of President Jefferson to ignore Mr. Marbury, he felt that it was unconstitutional for the supreme court to send a writ to the President forcing him to appoint him. He proved that the judiciary act of 1789 was unconstitutional and that it was not the Supreme courts job to force the president to do anything. This actually increased the Supreme courts power as they now had the power to review any laws for constitutionality.
Well, Mr. Marbury should get his job, but the Supreme court can't really force the president to give it to him. Sorry, Bill...
