Hi Andrea! Thank you! I can't wait to start my new position as Olean City School Special education teacher in 7th grade.
IDEA is a federal education law that was initially passed in 1975. It provides free, appropriate public education to eligible children with disabilities throughout the nation and ensures special education and related services for those children. It requires states to offer exceptional education and related services to children with disabilities who need them. It covers children from birth through high school. The public school system serves children ages 3 to 21.

What is that?
We must remember FAPE. Free Appropriate Public education!
In 1973, the US congress passed the Rehabilitation Act. The Rehabilitation Act was created to protect the rights of individuals with disabilities in activities or programs that receive federal funding. Specifically, section 504 regulation requires a school district to provide a “free appropriate public education” (FAPE) to each qualified person with a disability who is in the school district’s jurisdiction, regardless of the nature or severity of the person’s disability.

We want our students in the Least Restricted Environment.
I love this!
A Least Restrictive Environment (LRE) is a legal right for students with disabilities to be educated with their peers as much as possible. LRE helps determine where a student spends their time in school and how special education services are provided. Students should only be removed from the general education classroom if learning can't be achieved with supplementary aids and services. Any placement outside the general education classroom must be justified by the child's individual disability-related needs. The Special Education Committee, anyone involved in a student IEP, such as teachers, parents, or therapists, advocate for a student to get an LRE.

OSCD will offer IEP writing training to insure you are well prepared for each meeting you attend.
I will always create and IEP with parent input and with goals and objectives that my students will achieve!
A public school child who receives special education and related services must have an Individualized Education Program (IE.). The IEP must be individualized for one student and must be unique for the student. The IEP also allows teachers, parents, school administrators, staff providing services, and sometimes students to work together to improve educational results for children with disabilities. The IEP is the most important document for a child with a disability.

So, can you tell me how IDEA effects OCSD?
Our area doesn’t always have the ability to have the full continuum of services.
it’s either not cost-effective, or we can’t find the teachers to run the class, so unfortunately, we must send our students outside our district to receive the appropriate program for their needs.~ legal fees come into play when a parent isn’t happy with our placement and fights it. I had one parent file an impartial hearing claim to find his son a placement, and it was the same placement even if they didn’t file a claim. Some families aren’t happy.

So how has IDEA changed for teachers over the years?
OCSD gives you all the training and tools you may need to be successful under IDEA requirements.
Teachers in schools must be inclusive as much as possible, which means having all students, disability or not, in the same classroom. IDEA has raised the level of responsibility of regular classroom teachers by including them in the IEP process. IDEA also requires special education teachers to be highly trained.

NY State has put some recommendations and regulations in place to help guide OCSD in its compliance with IDEA.
OH really! What does that look like?
We make sure that everyone signs 408 forms to adhere to the Chapter 408 rules.
Andrea - NY State has designed common standards, performance standards, and assessments to maximize participation of students with disabilities.The presumption should be that a student with a disability is included in all standards and assessments unless there is a compelling educational justification for moving him or her away from some of the common standards and assessments. The NYS Ed website will be a great resource.

We create class lists based on the 36 month rule in a self-contained room (where applied).
This all seems doable!
I will provide a guide to writing an IEP to help assist you in that process as well as the CSE referral process
Andrea - NY State has also put a referral process for recommending students to the Committee of Special Education (CSE) Assessment accommodations should also be provided, but they should only be used to offset the impact of disabilities unrelated to the knowledge and skills being measured. They should be justified case-by-case, but a uniform set of criteria should guide individual decisions.

OCSD also discovered a resources to help families become better advocates for their students!
I know I will be the biggest advocate for my students! My students can trust me!
That is exactly what we hope to see from our teachers!
Andrea, in addition to being a voice for your students, you also help them understand their rights in school and in the community. You and the CSE team will help the families understand the IEP process and their specific disability. We want our teachers to be active and have good advocacy skills and do so by building the best relationships with all students and families.
