  • Loving v. Virginia Case
  • Background
  • In 1967, Mildred and Richard Loving lived in Virginia and decided to get married in Washington DC. They were then apprehended from their home after they went back to Virginia because they violated the law that doesn't allow someone to leave their state they reside in and get married with someone of a different race. They were both sentenced to 1 year in prison. 
  • Type of Case
  • This case is constitutional because if goes against what is said in the constitution about marriage between people of different races. 
  • It was heard in the district court in Richmond, Virginia.  The plaintiff was Virginia and the defendant was the couple. They were found guilty but they appealed it.

  • It went to the circuit court 1 in Caroline county and they found the Loving's guilty, so they charged them with violating Virginia's ban on interracial marriages. 
  • Circuit Court
  • When the Supreme Court heard the case
  • On June 12, 1967, the Supreme Court heard their case. The rule of four is when four of the nine justices accept the case. 
  • The Supreme Court found them not guilty because they found that it was against the Equal Protection Clause of the 14th amendment. The majority opinion was all nine justices said they were not guilty.

  • A precedent is an example of a past case that was similar to the case being held to see the outcome and analyze it.
