Even if a person doesn’t do Bedika they don’t violate the Issur De’oritiah of “Bal Yereh O’oBal Yematzei” because you always do Bittul Chametz, which would mean that you don’t own your Chametz anymore.
Why?!
The requirement to do Bedikah is NOT a “Din De’Oritiah”, and one does not violate “Bal Yereh O’oBal Yematzei” if they don’t do Bedikah.
Because the reason we do Bedikah is because the Chachamim made it a “Gezerah/Siyag” (A Fence) because there is a fear that a person may come to eat Chametz, and then he would violate the Issur Achilah. It is a “Din De’Rabanan” not “Din De’Oritiah” that if you don’t do Bedikah, you MAY come to eventually violate the Issur Achilah.
Do you have a source for this statement?
Yes! The Gemera on 10B says that there is a loaf of bread on a beam. Does one need to take a ladder to get it down? No. The Rabbis do NOT make him get it down because since the bread doesn’t come down on it’s own, he won’t come to eat it so he may leave it there. Or do we say that maybe sometimes the loaf of bread WILL come down so then he will come to eat it. So does he have to take it down?
Wait. I have a question on my own opinion! Why don’t you have to search all year long in your house for items that you can’t eat all year long?! Why don’t you have the same Chayev of Bedikah and Bittul all year round?! Why just by Pesach do we have to search?!
