  • President John Adams appoints multiple men to be part of the justices of the peace in the District of Columbia a few weeks before exiting office. Each man will receive a paper commission including William Marbury.and sealed
  • UGH
  • We have agreed that Marbury has the right to receive his commission, but we as the Supreme Court do not have power to issue the writ.
  • When President Jefferson took over, he denied James Madison to deliver the commissions.
  • Marbury v. Madison Supreme Court Case Importance
  • This case has been one of the most important case the Supreme Court has ever decided!
  • Marbury argued that he could go straight to the Supreme Court if he only wanted a writ of mandamus according to Congress in 1789. Marbury claimed that as his commission had already been made, so he was entitled to the writ. He also claimed that the Supreme Court had the power to issue the writ.
  • The Supreme Court claimed that it gets its power directly from the Constitution, and the Constitution has specific cases that can start at the Supreme Court. This claim shows that the 1789 law was unconstitutional. So they could not help Marbury get his commission.
  • In the end, this Supreme Court case was the first time the Supreme Court struck down an act of Congress for being unconstitutional. We also learned about how the idea that the Supreme Court has the final say in law being constitutional is called judicial review. The judicial review has let the judicial branch do two things: interpret the constitution and decide what it means, and stop executive and legislative branches from doing things that go against the Constitution.
