  • This case started in December of 1965 when John Tinker, Beth Tinker and Chris Eckhardt wore black armbands to school. When the school told them to take these bands off, they refused and were suspended.
  • Supreme Court's Ruling
  • YES! WE WON! I knew that the school violated our rights!
  • After the Tinker siblings were suspended, their family sued the school district and claimed that this suspension was a violation of their first amendment right, the Freedom of Speech. 
  • Constitutional Justification of the Supreme Court
  • The first amendment says that you are allowed to express yourself freely with limits.
  • The US District Court for the Southern District of Iowa sided with the school and ruled that wearing armbands could disrupt learning. They appealed to the Court of Appeals in circuit 8 and lost again. Finally, they appealed to the Supreme Court and the appeal was accepted.
  • The Tinker v. Des Moines Significance Towards Teens
  • Hey! You can't wear that.
  • Yes, I can. I have the freedom of speech. The First Amendment say so.
  • The Supreme Court ruled in favor of the Tinkers with a vote of 7-2. 
  • The court said that "shed their consitutitonal rights to freedom of speech or expression at the schoolhouse gate" However, the court did not give the students unlimited freedom to self-expression, as the First Amendment must be balanced so the school can keep order.
  • This Supreme Court decision is significant to teens today because it guarantees the right to express yourself freely in school and it could impact your life in school by being able to wear what you want.
