In the chant, Mauna Kea is the meeting point between the earth and the heavens
Our connection to Mauna Kea can be heard in the Kumulipo
Mauna Kea also holds 13 telescopes. Due to its location and the capabilities of these telescopes, new astronomical discoveries could be made. However, Mauna Kea is an extremely sacred place which has been disturbed by the construction of these telescopes(TMT).
Preservation of Mauna Kea is on the minds of many Hawaiians.
.
Gordon Squires, TMT spokesman, argues that Mauna Kea is the best location for studying the universe and that they have gone through a decade long process in order to build them on the island.
Undue burden or a law that restricts other laws could be applied to this argument. Still, we are left with the question, Does the addition of TMTs create more trouble than it's worth for Mauna Kea?
With this factor in mind, Can undue burden be applied in the restriction or continuation of TMT construction?
.
This clause bars the U.S. government from taking sides on a religious dispute. Within the context of this argument, they could not rule for or against construction of TMTs.
The Establishment clause is another argument that can be applied.

Mauna Kea should be entitled to equal protection, as the volcano holds religious and cultural connections.
There should also be more communication between the parties in order to emphasize the importance of Mauna Kea.
This could set a precedent where discovery and respect for culture are both taken into account when regulating land.
