  • If a complaint cannot be resolved by an alternative dispute resolution process, the Inquiry Committee may then initiate a formal discipline hearing by...
  • ...issuing a citation against the AVLIC member.
  • The citation will contain information about the complaint and the date, time & location of the hearings. The responding AVLIC Member will also receive resources to help them understand what to expect next.
  • A public notice of the discipline hearing will be posted on AVLIC's website.
  • At least 30 days before the discipline hearing, the Chair of the Inquiry Committee will contact the responding AVLIC Member to disclose all the information the committee has. The responding AVLIC Member also discloses at that time all of the information they have.
  • "This is called 'disclosure'. Disclosure is important because full disclosure of all the evidence before the hearing encourages a resolution of the matter before the hearing starts.

  • The Discipline Panel is responsible to consider evidence presented in a disciplinary hearing and provides a decision on the matter. Discipline Panel members are volunteers appointed by the AVLIC Board of Directors.
  • This is the Discipline Panel.
  • At least 15 days before the discipline hearing, the parties meet for a pre-hearing. The purpose of this meeting is to make sure everyone is ready to proceed on the date chosen for the discipline hearing.
  • Pre-Hearing
  • At the discipline hearing, the Discipline Panel listens to all evidence provided from both sides.
  • Discipline Hearing
  • After all of the evidence has been presented, the Discipline Panel considers the information they have and come to a decision.
  • The decision of the Discipline Panel is final.
  • If the Panel finds that the allegations against the member as set out in the citation have been proven, the Panel will then decide on what the appropriate penalty should be.
  • This second phase could happen later on the same day, or a separate penalty hearing date may be set.
  • The decision of the Discipline Panel, along with other relevant information, is posted on AVLIC's website.
  • The Chair of the Inquiry Committe monitors the AVLIC member's compliance with disciplinary orders from the Discipline Panel.
  • Refusing or failing to comply with a disciplinary order can lead to more consequences.
