  • The Supreme Court is a very powerful group of 9 judges. It has the power to block measures made by the president if the measures are unconstitutional(goes against the constitution of law). The judges in the 1930's were mainly republicans.
  • In 1935, the supreme court ruled that the national industrial recovery act (NIRA) was unconstitutional. This was because the constitution did not allow the president to control business. The supreme court also declared that the AAA was unconstitutional. Several other new deal measures were attacked by the supreme court.
  • Roosevelt was determined that the supreme court should not stop his reforms. All of the Supreme judges were old(over 70) so Roosevelt wanted them to retire. He asked congress to appoint his own 6 judges.
  • Roosevelt's idea to 'pack the court' was not approved by anyone, not even his own supporters. Many democrats believed that this would give Roosevelt too much power and some even accused him of being a dictator.
  • Many of the judges were traumatized with the recent events and retired voluntarily. The new judges were less hostile to the New Deal, so it was a win for Roosevelt.
  • Most of the New Deal procedures were accepted and were accepted into court. The Wagner Act and the Social Security act were also accepted despite their unpopularity.
