  • The Marbury v. Madison case established Judicial Review, which is the Supreme Court's power to declare a law unconstitutional. William Marbury never became Justice of Peace because the Judicial Act of 1789 was declared unconstitutional by the Supreme Court.

  • In 1816, the United States Congress passed an Act that allowed Federal Banks to be located and to operate within individual states in the U.S.

  • Mr.McColloch is right. The Necessary and Proper Clause of the U.S. Constitution states that the Federal Government can have a bank in whatever state without being taxed

  • Maryland made a statute imposing a tax on banks and McColloch, a cashier, issued bank notes without cooperating with the law and Maryland sued him for failing to pay the taxes. Congress has the power to incorporate a bank due to the Necessary and Proper clause, but the state of Maryland does not have the power to tax an institution when following the Congress.
