Maathai and her husband in 1979. Mwangi thought Wangari was too strong-minded to be a woman and that he was unable to control her. In addition to calling her "cruel" during the trial, he publicly accused her of adultery with a member of parliament. After the trial, Maathai referred to the judge as incompetent. That prompted the judge to charge her with contempt of court. She was convicted and sentenced to 6 months in jail,but only stayed 3 days.

The divorce was expensive, and with legal fees and her husband's loss of income, Maathai found that her university salary could not cover her and her children's expenses. She was able to work at the Economic Commission for Africa through the United Nations Development Program. In that job she traveled to Africa and was based in Lusaka, Zambia, she could not take her children with her and sent them to her ex-husband, although she visited them regularly. The children lived with their father until 1985.
