But on the side of Marbury he was elected in an unconstitutional way

But we as the supreme court can't make Madison deliver the papers...
With my jurisdiction I rule that Mr. Marbury will not remain in his position because it is unconstitutional and Madison's choice to withhold documents is beyond the courts control and rule
